Car rental agreement

1. The renter/borrower must be at least 21 years old and have an international driver's license or car driving license as issued by a government agency. Ready to bring the original document to show on the contract signing date. The renter/borrower agrees to allow the lessor/lender to take a photo or photocopy of the identification card or passport. or driver's license as evidence.

2. The renter/borrower must use the vehicle for tourism or non-illegal business operations only. The renter/borrower agrees not to use the rented/borrowed vehicle for commercial use. or commit a crime and do not carry or have illegal items in the vehicle or do any other act in violation of state law. If an offense has occurred, the renter/borrower is solely responsible.

3. The renter/borrower must use the vehicle only in the area that has been reported to the lessor/lender as specified in the contract. If the renter/borrower violates this and the lessor/lender cannot contact the renter/borrower within 2 hours, the lessor/lender has the right to notify the authorities to take legal action against the renter/borrower. immediately (Delimited areas that can be driven: Phang Ngam, Surat Thani, Krabi)

4. In the case where the renter/borrower Acting outside of the agreement as in 2-3. Causes the lessor/lender to take the vehicle back. The renter/borrower is willing to bear the costs of returning the vehicle as requested by the lessor/lender.

5. The renter/borrower agrees not to sublease, transfer, or deliver the car to another person for driving.

6. The renter/borrower agrees that he has received complete information about the car and insurance from the lessor/lender or agent on the rented car on the date of receiving the car.

7. The renter/borrower must not drink alcohol while driving. or drink alcohol and drive If there is any damage due to this, whether intentional or not. The renter/borrower is responsible for all damages.

8. If the rented car is damaged or has an accident. The renter/borrower must immediately notify the lessor/lender of the incident and the renter/borrower agrees to pay the penalty/damage deductible. By the rate of fine/first portion of damages That shall be according to the following reasons and cases:
In the case where the damage is caused by an event that is related to the insurance.
A. In case of accident If the renter/borrower is right the renter/borrower is not responsible for damages.
B. In case of accident If the renter/borrower is at fault or there is no other party the renter/borrower will be liable for damages. (“First Damage”) at a rate between 1,000 and 50,000 baht. When considered, the damage is within the amount covered by the insurance company.

9. The renter/borrower must be careful not to lose the rental car. If the rented car is lost for any reason The renter/borrower must present the original key only to the renter/lender. The renter/borrower is responsible for paying damages in the amount of 20 percent of the estimated vehicle price or the difference in costs including excess not covered by the insurance company. Except in the case where the original key and the vehicle are all lost together. Or the case has ended and there is evidence that should be believed or may be believed that the renter/borrower was at fault in causing the car to be lost. In which case The renter/borrower must pay 100 percent of the appraised vehicle price.

10. The renter/borrower agrees to let the lessor/lender inspect or move
Move the car when the lessor/lender deems it appropriate to do anything. To prevent damage to the lessor/lender or the vehicle that can be rented/borrowed. without needing to notify in advance

11. If all equipment inside the car, such as documents inside the car, car seats, tires, spare parts, jacks, keys, etc. Damaged or lost During car rental The renter/borrower must pay all fines as charged by the lessor/lender. The lessor/lender will use the penalty price criteria based on the price set by the car service center of that brand and the actual service charge.

12. Car tires: If the tire is punctured, the renter/borrower must repair the tire and return it to the lessor/lender. If the tire breaks, the renter/borrower must purchase branded tires. and the original design to the new lessor/lender. However, the lessee/borrower must inform the lender of the reason immediately. 13. In the event that the rented/borrowed vehicle is seized or in the case of being fined for reasons arising from the use of the renter's/borrower's car Through the lessor/lender Has the right to require the renter/borrower to pay any fines or fees. From the aforementioned reasons, it is true. If the renter/borrower does not pay the said fine or fee The lessor/lender has the right to deduct the said amount from the security deposit immediately without consent and has the right to claim compensation from other damages (if any) realistically.

14.Counting time to rent a car Another 24 hours will count from the time the vehicle is picked up, thus counting as 1 day. The renter/borrower must return the vehicle on time as agreed at the specified location. If the vehicle cannot be returned at the time and/or place specified, the renter/borrower must notify the lessor/lender at least 3 hours before the vehicle is due to be returned. The lessor/lender has the right to refuse to extend the rental/borrowing period without it being considered a breach of the contract. In the event that the lessor/lender agrees to extend the time for returning the vehicle. The renter/borrower agrees to pay additional fees as shown in the following examples.

Example: Rent 1,000 baht per day, overtime fee 100 baht per hour.
Rental agreement: Pick up the car on January 5th at 10:00 a.m. Return the car on January 5th at 6:00 p.m. The full rental price for 1 day of rental is 1,000 baht. The car can be returned on January 6th at 10:00 a.m. without charge.
Rental contract: Pick up the car on January 5 at 10:00 a.m. Return the car on January 6 at 12:00 p.m. The contract rental price for 1 day and 2 hours is 1,200 baht. 15. The lessor/lender does not have any responsibility. In all assets that the renter/borrower forgot in the rented car.

16. The renter/borrower must fill up the tank as specified before returning it. Otherwise, the lessor/lender can charge you for the fuel. or agree to deduct the missing fuel cost from the insurance money immediately If the renter/borrower fills up with fuel that does not match the specified type. The renter/borrower agrees to compensate for all damages incurred.

17. Under this contract the lessor/lender must return the security deposit to the renter/borrower in full when the renter/borrower returns the vehicle. provided that the lessee/borrower has not breached the contract and there was no damage of any kind. On the other hand, if the renter/borrower breaches any of the above-mentioned contracts. The renter/borrower agrees to allow the lessor/lender to immediately forfeit the security deposit and agrees to sue to compensate for actual damages. If the renter/borrower fails to pay the fine, in that case the lessor/lender can exercise the right to fine. The lessor/lender has the right to immediately deduct such penalty from the security deposit.

18. This rental contract is effective only on the rental/borrowing date specified in the contract. or including contracts that include a lease extension If the renter/borrower Unable to return the vehicle on time and not notifying the lessor/lender immediately If the time to return the car is more than 3 hours or the renter/borrower of the car cannot be contacted for any reason. The lessor/lender/owner/owner of the vehicle can immediately report the vehicle to the police for criminal prosecution for theft by trick or embezzlement. If there is any damage or processing fee arise from this the renter/borrower agrees to be responsible without any objection.

19. If the renter/borrower Breach of any of the promises mentioned above. The renter/borrower agrees to allow the lessor/lender to immediately forfeit all deposits placed in order to alleviate the initial damage. However, in the event that the damage exceeds the deposit, The lessor/lender has the right to claim damages or bring a case to court to claim actual damages.
